Terms and Conditions

I. General

1. Scope of Application

These Terms and Conditions ("AiryRides T&C") of AiryRides Technologies LLC ("AiryRides") govern (i) the access and use of the website https://airyrides.com/, the mobile application AiryRides ("AiryRides App"), and other associated applications (collectively the "Platform"), and (ii) the services provided through the Platform.

2. About AiryRides

AiryRides arranges agreements on Services ("Service Agreements") which are concluded between users and Service Providers.

3. Users

"Users" in terms of these T&C are individuals and legal entities who use the Platform, with or without having registered with AiryRides for the use of the Services or the Platform. Registration and the use of the Services is limited to adults.

4. About Service Providers

Service Providers can be Service Providers registered (i) with AiryRides for the use of the Platform ("Platform Service Providers"), or (ii) with a transportation network company ("TNC") with which AiryRides has a cooperation agreement.

5. About the Services

Services include one-way transfers (a transfer from a defined starting point to a defined destination or a transfer from a defined starting point without defined destination).

6. Acceptance of T&C

By accessing, registering for or using the Platform, or concluding agreements arranged by AiryRides via Associated Applications, the User accepts the application of these T&C. Therefore, please read these T&C carefully before using our services.

7. Modification of T&C

AiryRides reserves the right to make modifications of these T&C which do not affect Section I.7 and AiryRides' main performance obligations, and are not equivalent to the conclusion of a new contract with fundamentally different terms.

8. No application of terms and conditions of user

Terms and Conditions of the User are not applicable, even if AiryRides does not explicitly object to their inclusion.

9. Language of agreement

The language of the agreement is English.

10. Availability of these T&C

The current version of the T&C shall always be displayed, and Users are also authorized to print or save electronic copies.

11. Data Privacy

AiryRides and Service Providers collect and store the personal data necessary to process business transactions and comply with applicable U.S. data protection laws. The privacy policy can be found at https://airyrides.com/privacy-policy.

II. Registration for the Platform

1. Registration process

Registration for the Platform is voluntary and free of charge. Guest bookings are possible. AiryRides reserves the right to accept or reject any registration request.

2. Accuracy of details

Users must maintain accurate, up-to-date, and complete account information.

3. Passwords

Users are responsible for keeping login credentials secure.

4. Liability for misuse of user account

Users are liable for activities under their account unless unauthorized use is not their fault.

5. Termination

Users may terminate accounts anytime by emailing support@airyrides.com. AiryRides may also terminate accounts at its discretion.

III. Service Agreements — Contractual Relationship and Conclusion

1. Contractual Relationship

AiryRides acts solely as an intermediary. Service Agreements are concluded directly between Users and Service Providers.

2. Conclusion of Service Agreements

Booking is completed when the User submits a booking request and receives confirmation.

Booking conditions vary depending on service type and provider. Please refer to our Booking Conditions for full details.

IV. Cancellation

1. Cancellation conditions

Cancellation policies depend on booking class and provider.

2. Cancellation process

Cancellations must be made via the Platform.

V. Payment

1. Fees

Fees are due upon completion of services unless otherwise agreed.

2. Payment methods

Payments are processed via selected payment methods during booking.

3. Chargebacks

AiryRides reserves the right to recover unpaid amounts via collection agencies if necessary.

VI. Liability

AiryRides acts only as a marketplace and is not liable for actions of Service Providers. Liability is limited to the maximum extent permitted under U.S. law.

VII. Final Provisions

1. Communication

Official communication may occur via email.

2. Assignment

AiryRides may assign rights and obligations with notice.

3. Force majeure

AiryRides is not liable for events beyond reasonable control.

4. Governing law

These Terms are governed by the laws of the State of Wyoming, USA.

5. Venue

Legal disputes shall be resolved in Wyoming, USA courts.

VIII. Dispute Resolution

AiryRides does not participate in arbitration unless required by law.
